Accelerated Route to Membership (ARM) Course

近年來，國際仲裁相關議題，持續受到各界矚目。對台灣涉外案件處理者而言，也不得不重視及了解應如何處理國際仲裁事件。特許仲裁人學會(Chartered Institute of Arbitrators http://www.ciarb.org/about) 自1915起提供國際爭端解決之相關教育訓練，至今已102年歷史。目前有14,000名會員，分布於世界133國家，並設有37個分支機構(branches)。本次仲裁課程將提供對國際仲裁事件處理之教育訓練，涉及之議題包括: 國際仲裁之基礎原則，案件處理之注意事項等。課程適合執業律師、仲裁人、政府相關部門、公司法務參加。課程將全程以英文進行，教材亦均為英文。兩天課程當中，將以小組討論為主，並有相關測驗(assessment)。通過者可取得特許仲裁人學會之進階會員資格(MCIArb)。

ARM Course

Taipei Chapter, CIArb East Asia Branch and the Chinese Arbitration Association is now receiving registrations for the captioned course, a 1.5-day workshop for qualified professionals wishing to obtain the Institute’s Membership designation (MCIArb).  The number of candidates is limited.  Non-members of CIArb are welcome to register for the course, however, preference will be given to CIArb Associates if space becomes limited.

Upon acceptance, candidates will be invited to participate and pay the course fee.  You will also receive a pre-course assignment, i.e. an essay to be handed in before the commencement of the course. 

This is not a teaching course, but a series of workshops conducted mainly in small groups where all candidates are expected to participate actively in discussions.  During the workshops, the candidates will be assessed on knowledge, judgment and presentation by experienced practitioner tutors.  A closed book examination will follow the workshops on the next day.  The course will be conducted in English.

*The minimum number of enrolment required is 15 people.  CIArb and CAA reserve the right to cancel the course if the required number is not reached.  In that case, any course fees paid would be returned in full. Cancellation policy: prior to August 31, 2017, refund of TWD 14,000; between September 1 and September 20, refund of TWD 10,000; After September 20, no refund.

 

ABOUT THE ASSESSORS                                                                                               

Mary Bee Lay Thomson

Mrs. Thomson qualified as a London barrister in 1983 before working in industry (shipping and insurance) and then re-qualifying as a solicitor in London. She moved to Hong Kong in 1992 where she practiced as a solicitor, including as partner at Hong Kong and international law firms, the last being at Dentons. In 2013, she joined the Hong Kong Bar and rejoined the English Bar to focus on her growing arbitrator practice.

Mary specializes in commercial dispute resolution in the financial, insurance, transport, energy, commodities and manufacturing sectors. Mary's arbitration practice is exclusively international, institutional and ad hoc.  She has been appointed arbitrator since 1996 including pursuant to "commercial man” clauses. She sits as arbitrator on arbitrations seated in Hong Kong, Singapore, London, Manila and elsewhere, and is on the panel of a number of regional arbitration centers as well as the LCIA, the CIArb arbitrator panel as well as the Aspiring full member list of LMAA.  She is also on a number of mediator panels. 

Mary is currently Chair of the CIArb, East Asia branch with regional responsibilities for the East Asia branch. She is a previous chair of the arbitration committee of ICC Hong Kong.

Dr. Helena H. C. Chen

Helena is qualified in Taiwan, Mainland China and New York State. She is a Fellow of the Chartered Institute of Arbitrators and listed on the panels of arbitrators of ICDR, CIETAC, SIAC, KLRCA, KCAB, ACICA, SHIAC, SCIA, BAC/BIAC, CAA, LCIA-MIAC Arbitration Centre, VIAC, Arbitration Center Across the Straits, PIAC, THAC etc. She is an accredited adjudicator with KLRCA and listed as one of the Recommended Experts of the Construction Dispute Board (DB) of Beijing Arbitration Commission. Helena is a National Committee Member of the SIAC Users Council, the Vice-Chairperson of the Mediation Center of CAA, Associate Mediator for the Singapore Mediation Centre and listed on the panel of mediators of CCPIT/CCOIC Mediation Center. She has experiences in acting as a sole arbitrator, a chair arbitrator and a party-appointed arbitrator in domestic and international disputes.

Helena has vast experiences in arbitration, infrastructure projects and cross-strait investment. Helena is an international consultant retained by the Asian Development Bank (ADB) and has been named to the Who's Who Legal of Leading Construction Lawyers for many years from 2011 and was featured in a roundtable discussion by Who's Who Legal (Roundtable: Construction 2013). She is one of the founding Supervisors of Taiwan Construction Law Society and served as a director thereof. She writes and lectures widely on international arbitration, mediation, PPP and construction law topics.

Dr. Winnie Jo-Mei Ma

Winnie Ma has taught at Bond University in private international law and property law etc. since September 2000, after being admitted as a solicitor of the Queensland Supreme Court through articled clerkship with Allens Linlaters in Brisbane. She has also taught international commercial arbitration, dispute resolution and legal English in both English and Chinese at National Taiwan University and Soochow University since 2012.

Winnie has authored book chapters and articles on international commercial arbitration (including public policy, parallel proceedings, arbitrator challenges, choice of law and enforceability of arbitral awards), as well as private international law (specifically Australian legislation concerning personal property securities). Her SJD thesis, “Public Policy in the Enforcement of Arbitral Awards: Lessons for and from Australia”, has achieved 10,000 full-text downloads since November 2006.

Currently based in Taiwan, Winnie is a member of National Taiwan University’s Asian Center for WTO and International Health Law and Policy. She serves on the editorial boards of Contemporary Asian Arbitration Journal and Chinese (Taiwan) Yearbook of International Law and Affairs. She coordinated an international project involving Chang-fa Lo (Justice of Taiwan’s Constitutional Court), which culminated in a draft Convention on Cross-Border Enforcement of International Mediated Settlement Agreements.

Winnie was the project leader for drafting the CAAI Arbitration Rules before being appointed the Deputy Secretary-General of CAA (Chinese Arbitration Association, Taipei) since March 2017.

Houchih Kuo

Houchih is a senior counsel with Pontis Law and Kuo, Chen and Partners. He currently chairs Chartered Institute of Arbitrator (CIArb)’s Taipei chapter and is an adjunct professor of Soochow University law school. Houchih has represented clients in ad hoc and institutional arbitrations with seats in the U.S., Singapore, Hong Kong, Japan, the PRC and Taiwan.

Houchih has been invited to speak in international arbitration conferences or seminars organized by the CIArb, HKIAC, the International Chamber of Commerce (ICC), Korean Commercial Arbitration Board (KCAB), Singapore Academy of Law, CAA, Ministry of Justice (Taiwan), and Department of Justice (the Philippines).

Houchih’s main practice areas are international arbitration, mediation, mergers and acquisitions, corporate law, and intellectual property rights. He regularly assists international and domestic companies in high-tech, tobacco-alcohol, manufacturing, textile, construction, real estate development, pharmaceutical, entertainment, as well as petrochemical sectors.

Alison Chang

Alison is qualified in Taiwan, Mainland China and the New York State. Her practice mainly focuses in the areas of cross-border M&A, foreign investment, corporate legal affairs and international arbitration. She has represented Chinese and international clients from various industries (including automobile, manufacturing, media, energy and resources, pharmaceutical and medical devices, and TMT) in various cross-border transactions as well as commercial arbitrations in Mainland China, Hong Kong, Taiwan and the United States.

Alison is a senior foreign legal consultant at King & Wood Mallesons.  She obtained her Bachelor of Business Administration from National Taiwan University.  She later received her Master's Degree of Law from National Taipei University and her LL.M. from Columbia University.

Alison Chang is qualified in Taiwan, Mainland China and the New York State. Her practice mainly focuses in the areas of cross-border M&A, foreign investment, corporate legal affairs and international arbitration.
