CAA's New Branch in Hong Kong

The Chinese Arbitration Association, Taipei (CAA) is the first non-profit organisation with quasi-judicial function in Taiwan established in 1955. To expand its services in cross-border dispute resolution, CAA has established its first foreign branch, CAA International Arbitration Centre (CAAI), registered in Hong Kong on December 7, 2018 as a not-for-profit company limited by guarantee.

The organisational structure of CAAI consists of Council, Court of Arbitration, Secretariat, and International Advisory Board. CAAI Council is entrusted with strategic guidance and decision-making, whereas CAAI Court of Arbitration is the final decision-making body to safeguard the appropriate interpretation and application of CAAI Arbitration Rules. CAAI Secretariat is responsible for case management, day-to-day administration, as well as providing assistance required by CAAI Court of Arbitration. CAAI International Advisory Board consists of leading experts with profound international prestige, advising CAAI Council on institutional management and development strategies.

CAAI provides an additional option for arbitrations seated outside Taiwan. Apart from revising its Arbitration Rules, CAAI has also established its Code of Ethics for Arbitrators and Parties, Guidelines on Case Management Conference, as well as Notes on Composition and Procedure of CAAI Court of Arbitration. These assist with ensuring the impartiality, neutrality, efficiency and enforceability of CAAI arbitrations. 2018 Taipei International Conference on Arbitration and Mediation

On August 27-28 2018, CAA and the Asia Center for WTO & International Health Law and Policy, National Taiwan University College of Law (ACWH) co-hosted the2018 Taipei International Conference on Arbitration and Mediation in Taipei.

This year’s conference topics included: “New Interactive Relations between Court Systems and Arbitration”, “Relations among Litigation, Arbitration and Mediation”, “Ex Aequo et Bono and Lex Mercatoria in International Arbitration”, and “Issues in Investment Arbitration Regime”. Over twenty distinguished scholars and practitioners presented and engaged in active discussions with 80 other participants.

This annual event since 2007 has successfully cemented CAA’s international reputation as a high-quality platform for sharing the latest developments in international dispute resolution.

Q & A session

2018 Cross-Strait Arbitration Conference

To facilitate collaboration and capacity-building between Taiwan and Mainland China, both CAA and CIETAC have been taking turns to host the Cross-Strait Arbitration Conference since 2001. The 18th conference this year was held in Taichung for the first time, coinciding with the 2018 Taichung World Flora Exposition.

Conference speakers gave comparative analyses and commentaries on three topics: recent development of arbitration in Taiwan and Mainland China; ethical regulation of arbitrators; and evidence-taking in arbitral proceedings. They also explored further institutional collaboration for improved service requirements, greater platform for exchange and networking, and a more diversified dispute resolution system.

CIArb-CAA Event and Inaugural ARF Course in Taipei

In order to deepen the partnership between the Chartered Institute of Arbitrators (CIArb) and CAA, CIArb East Asia Branch Taiwan Chapter collaborated with CAA again in holding two events in September 2018, respectively the CIArb East Asia Branch Taiwan Chapter Young Members Group (YMG) Launch on September 7, 2018, and the inaugural Accelerated Route to Fellowship (ARF) – International Arbitration Course on September 23-24, 2018. Both events took place at CAA Taipei Office.

The launch of Taiwan Chapter YMG hopes to promote extensive interaction and information exchange among legal practitioners and arbitrators under the age of 40. The ARF Course offers training and assessment for candidates who usually have five years of experience in arbitration and/or ten years of experience in legal practice, and wish to become qualified as Fellow of CIArb. The inaugural Taipei ARF course attracted 23 candidates from Taiwan and other jurisdictions. Its course assessors were Mary Thomson, Glenn Haley, Edward Chow and Helena Chen, together with shadow assessors, Winnie Jo-Mei Ma and Alison Chang.

Seminar on the Practice of Arbitration

On December 14, 2018, CAA collaborated with the Judicial Yuan and held the 2018 Seminar on the Practice of Arbitration. The Seminar took place in the Judges Academy and focused on two topics that closely related to recent debates and relations between arbitration and judicial institutions: “Arbitration by Applying Law or Ex Aequo Et Bono” and “The Assistance by Court in Arbitration Procedure”.

This annual cooperation between CAA and the Judicial Yuan aimed to enhance the validity and effectiveness of arbitral awards, to assist the courts in dealing with cases concerning the setting aside of arbitral awards, and to develop consensus and best practice in arbitration.
